Return Goods Policy
Effective: June 1, 2010
Policy:
Products eligible for return must be expired and in unopened packages. Product can be returned at any time within six (6) months prior to expiration or twelve (12) months following the expiration. 80% credit will be issued based on current price unless such products are subject to any restrictions listed below. Prior authorization is required and should conform to the terms hereof.
Non-Returnable Goods
Non-returnable goods consist of the following:
Merchandise sold on a non-returnable basis, professional sample, professional package, free goods, or with similar markings or special label.
Merchandise damaged by catastrophes such as fire, smoke, water or involved in sacrifice, salvage, bankruptcy or fire sales.
Merchandise sold, purchased or distributed contrary to law.
Open packages or packages from which labels have been removed.
Products that have been discontinued.
Partials.
Non-approved returns.
Shipping Errors
Products shipped in error by us are subject to 100% credit on the return of the product(s) if returned in original condition. We must be notified of error within fifteen (15) days of receipt of product and returned within thirty (30) days of receipt.
Order Errors
A 20% restocking fee will be charged for the return of product(s) ordered in error. Customer must notify us within fifteen (15) days of receipt of product and must be returned in its original condition. Refrigerated product is not eligible for return.
Authorization
All returns must be authorized in writing by our Customer Service Department. Products subject to return goods credit must not be destroyed without prior written authorization from us. We reserve the right to inspect all returns prior to issuing credit and its decision is final concerning the determined value of returned goods.
Claim Merchandise
Even exchange or credit will be allowed for loss or damage evident at time of delivery if noted on the carrier's delivery receipt and reported to us within five (5) days. Concealed loss or damage must be inspected by carrier within fifteen (15) days after delivery and carrier's inspection report must be forwarded to us.
Our policy strictly prohibits any sales representative or any other employee from giving samples or stock packages to any customer to replace merchandise. All returns must be made according to this return policy.
Product Recall
In the event of a confirmed product failure, a recall initiated by us, or a recall ordered by a government agency, we agree to pay reasonable costs incurred by the account in performing recall services requested by us. All other recall costs shall be borne by customer.
WARRANTY; DISCLAIMERS: We warrant that at the time of shipment the product(s) shall:
Be free from defects in material workmanship;
Not be adulterated within the meaning of the country laws;
Be manufactured in accordance with the current Good Manufacturing Practices and comply with all applicable labeling requirements.
WE MAKE NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, IRRESPECTIVE OF WHETHER ATTRIBUTABLE TO BREACH OF WARRANTY.
